Understanding Hit-and-Run Accidents

Section 69 of the Traffic Safety Act requires drivers to stay at the scene of an accident, offer reasonable assistance, and provide the following information to the other driver(s) and police when it’s safe to do so:

  • Name and address of the driver
  • Name and address of the registered vehicle owner, if different from the driver
  • The licence plate number
  • Insurance card

If a car hits you and the driver leaves the scene without offering aid or providing the required information, it’s considered a hit-and-run collision. There are a few exceptions:

  • If a driver is unable to exchange information because of injuries, a passenger must provide the information if present and able.
  • Drivers who are alone and unable to provide their information due to injuries must provide the information as soon as they are able.

Drivers who knowingly leave the scene of an accident may face penalties under provincial or federal law.

Why Do Hit-and-Run Drivers Flee the Scene?

Some hit-and-run drivers panic and flee in the moment, or leave to avoid legal or financial consequences.

In some cases, hit-and-run drivers flee because they’re committing other offences, and they think they have more to lose by remaining at the scene. Here are some common offences we’ve seen linked to these incidents:

These violations are also among the top causes of car accidents in Alberta.

Your Legal Rights After an Edmonton Hit-and-Run Accident

Being in a hit-and-run accident in Edmonton shouldn’t mean that you’re left paying the bill for medical treatments or time off of work. While police work to identify the driver, our Edmonton car accident lawyers can also help find evidence after the fact.

We’ll do everything in our power to hold them accountable and get you the compensation you deserve. It won’t cost anything to speak with our legal team. Call us at (780) 540-0557 to book a free consultation.

How Are Hit-and-Run Accident Damages Recovered if the Driver Is Never Found?

Even if the driver is not identified, you may have several options for compensation. In Alberta, you can receive compensation for a hit-and-run after a physical injury through:

  • Section B benefits on your own policy, which can provide up to $50,000 per person for medical treatment
  • The Motor Vehicle Accident Claims (MVAC) Program, which typically offers up to $200,000
  • The Family Protection Endorsement (SEF 44) from your own insurance policy
  • Any optional coverage you’ve purchased, such as collision and all perils coverage

Filing an insurance claim for a hit-and-run accident isn’t always easy. Insurance companies may try to limit what they pay, even if you file a claim with your own insurance company. Remember, as a business they are motivated to protect their bottom line. We typically suggest speaking to an injury lawyer before accepting an insurance company’s settlement offer, so you know what your rights are.

What Compensation Is Available for a Hit-and-Run Accident?

Depending on the circumstances of your hit-and-run collision, you could receive compensation for things like:

  • Medical bills
  • Ongoing and future medical expenses
  • Lost income
  • Lost earning capacity
  • Property damage
  • Pain and suffering
  • Emotional distress
  • Disfigurement
  • Impairment

Every accident claim is unique, so what and how much is available will vary based on coverage and the facts of your case.

Frequently Asked Questions About Hit-and-Run Accidents

Our answers to common questions about hit-and-run accidents are below. If you’ve been injured in a hit-and-run, contact us directly for legal guidance specific to your situation.

What Should I Do Immediately After a Hit-And-Run?

Call 911 to report the accident to the police and request emergency medical services if you are injured. Provide police with any details you remember about the vehicle, such as the make, model, colour, and licence plate number. If any witnesses are present, take down their names and contact information.

Even if you feel fine in the moment, adrenaline can mask serious injuries. Consider getting assessed by a medical professional as soon as possible. In these types of cases, the sooner you talk to an injury lawyer, the better as evidence can be easier to gather at this stage.

How Long Do I Have to File a Claim?

You generally have two years from the date of the accident to file an injury claim for your hit-and-run car accident in Alberta, but this doesn’t mean you should wait to contact a lawyer. Valuable evidence may only be available for a limited time, so it helps to get answers early.

It won’t cost you anything to speak with our legal team. Contact us today to book your free consultation. We’re here for you.

How do Contingency Fees Work at Litco Law?

We don’t charge any fees upfront, and you don’t pay any legal fees while your claim is ongoing. During your claim, we cover typical costs like court filing fees, expert witness retainers, and travel costs. Our fee is a percentage of your settlement, which will be agreed upon before you hire us. If you don’t get paid, neither do we.

How Quickly Can I Expect Updates from My Lawyer?

We’ll contact you at least once every 30 days with an update. Our client portal provides 24-hour access to your claim, so you can easily upload receipts and check the status of your claim at any time. You are welcome to call our team anytime if you have questions or just want to check in, and we’ll get back to your emails within 24 hours or next business day.

What Is No-Fault (Care-First) Insurance in Alberta?

The Alberta government has proposed a no-fault auto insurance model called “Care-First” insurance which would come into effect on January 1, 2027. Under this system, your own insurance would be in charge of covering your medical expenses and losses after a collision, no matter who was at fault.

One of the downsides to Bill 47 and the proposed system is that it could limit your right to sue for more compensation. The insurance companies would also get to decide what amount of care and compensation you receive, and for how long. That means you may not be able to pursue compensation for pain and suffering or other losses. Learn more about Care-First here.
