What happens after I’ve been injured in an e-scooter accident?

Chances are you’ve tried (and maybe even crashed on) an e-scooter over the past few years. These days, almost everyone has downloaded an app to go for a ride, especially since prices are cheap and used scooters can be left anywhere. Despite the affordability and convenience of these vehicles, there are safety risks and legal issues that come with the novelty of ridesharing.

If the rider of an e-scooter was hit and injured by an insured car through no fault of their own, the case is usually fairly cut and dry. Just like in a standard Motor Vehicle Accident, the insurance of the at-fault party will likely cover liability and damages. But it’s not always that simple. For instance, in the below scenarios, liability becomes more complex:

  • The rider injures someone else through their negligence while riding a rented e-scooter, and has no insurance;
  • The rider is impaired;
  • An unknown vandal throws an e-scooter into the street and a car runs over it, damaging the car and injuring the passengers;
  • A child gains unauthorized access to an e-scooter and is injured in the course of the ride;
  • The e-scooter is mechanically faulty and causes injury to a rider

In the instances above, things aren’t so black and white— which means there may be back-and-forth about insurance (or lack thereof), or different interpretations of who should pay for what. Plus, it can be tricky to make sense of e-scooter user agreements, terms and conditions, and waivers. That’s why it’s key to speak with an experienced lawyer for answers to all of your e-scooter questions. At Litco Law, we’ll help you find a solution… even if we’re not it.
