“How do I claim my loss of income in a Personal Injury case?”
What we’re talking about here is your loss of wages and inability to work because of an accident, or the fact that you’ve had to change your duties at work related to an accident, or potentially that you’ve had to change your profession or your line of work altogether because of the accident. So, let’s say for example that previously you were doing something more physical in your everyday work life. Now the doctor says- and you determine with your doctor- that you’re no longer able to do that (line of work) anymore because it’s too much of an onerous task and too difficult for you physically to perform your day-to-day work activities. In that case, it could be suggested that you try and find something that is less physical, which may impact your income. You could have been at your job for 20 years making a very good income… you might have built up a rapport with your company and had several promotions, and now you’re at a point where you can’t do the work anymore.
So, whatever it is that you lose in terms of income from an accident may be recoverable in a claim against the other side. Another example might be that perhaps you’re working a job part-time while you’re going to university and you’re earning twenty-five dollars an hour. Now because of the accident, you’re unable to do that work and you’ve lost 100 hours of your work at twenty-five dollars an hour. Simply put, you could be able to recover whatever the total that is as part of your legal claim.
