Can You Drink While Boating in Alberta?

Passengers can only drink legally on a boat if all of the following conditions are met:

  • a permanent toilet
  • cooking and sleeping facilities, and
  • the boat is anchored or secured alongside a dock.

If those requirements aren’t in place, alcohol is not allowed on board, even for passengers.

What’s the Difference Between Drunk Driving and Drunk Boating?

In the eyes of the law, there isn’t one. The penalties for drinking and boating are the same as for drinking and driving a car. That means it’s a criminal offence to operate a boat while impaired by alcohol or drugs.

If your Blood Alcohol Concentration (BAC) is over 0.08%, you are considered impaired… whether you’re behind the wheel of a car or at the helm of a boat.

  • First offence: minimum fine of $1,000

  • Second offence: minimum of 30 days in jail

  • Third offence: minimum of 120 days in jail
