Common Causes of Rear-End Collisions in Edmonton

Rear-end collisions account for about 21.5% of all car accidents in Alberta, making them one of the most common types of collisions in the province. No matter how cautious you are, you can’t control what the driver behind you is doing.

You might be stopped at a light or slowing for traffic when another driver looks down at their phone, follows too closely, or doesn’t slow down in time. When looking at the top causes of car accidents, most rear-end collisions in Edmonton happen because the rear driver is:

  • Distracted
  • Speeding
  • Tailgating
  • Failing to adjust to bad road or weather conditions
  • Driving while impaired

Even in poor weather, the rear driver is responsible for adjusting speed and increasing following distance to avoid an accident. If you’re injured in a rear-end collision, our lawyers will investigate, gather evidence, and work to hold negligent drivers accountable.

Injuries Commonly Caused by Rear-End Collisions

Rear-end collisions can happen at any speed, and even low-speed impacts can lead to serious injuries that could significantly impact your health and life. At higher speeds, the force can push your vehicle into another lane or intersection, causing more severe, long-lasting harm.

Some of the most common injuries we see in rear-end collisions include:

These injuries can affect every part of your daily life, from working to sleeping comfortably, and recovery can take time. Our team will ensure that your claim reflects the full impact of your injuries.

Who Is Liable for a Rear-End Collision in Alberta?

In most rear-end collisions, the driver who hits another vehicle from behind is at fault. That means if you were rear-ended, you likely have grounds to file an injury claim. Still, every situation is different, so we usually recommend consulting with an experienced Edmonton rear-end collision lawyer early in the process.

Liability may involve:

  • The rear driver
  • Another negligent driver
  • The manufacturer of a defective vehicle part
  • A negligent government entity
  • A trucking company, if a commercial truck was involved
  • An employer, if the driver was working
  • A vehicle owner, if it’s someone other than the driver

At Litco Law, it won’t cost you anything to speak with our legal team, and personal injury consultations are always free. Our lawyers investigate the accident to determine responsibility and whether there were contributing factors such as a defective vehicle component or unsafe road conditions.

Who Pays the Damages for a Rear-End Collision Claim in Edmonton?

If you were hurt in a rear-end collision, your Section B accident benefits under Alberta’s Standard Auto Insurance Policy will provide some coverage for medical expenses and lost wages up to your coverage limit.

In addition to your Section B benefits, you may be able to file an injury claim against the the negligent driver and any other responsible parties.

For vehicle damage, you must file a claim with your Direct Compensation for Property Damage (DCPD) policy. If you are found partly at fault, the amount you receive may be reduced based on your share of responsibility. That being said, if you also have collision coverage, it can help pay for any remaining vehicle damage that your DCPD policy does not cover.

What Compensation Can You Claim After a Rear-End Collision?

When you’re already suffering as a result of someone else’s carelessness by having to cope with painful and debilitating injuries, you shouldn’t have to pay the financial costs, too.

After a rear-end accident in Edmonton, you may be able to claim compensation for your losses, including:

  • Medical expenses. Necessary medical treatment, tests, rehabilitation, therapy, assistive devices, and prescription costs
  • Cost of future care. The cost of long-term care and any medical expenses you’re likely to have over the course of your lifetime because of your injuries
  • Lost income. Reimbursement for lost wages from missed workdays or having to perform lighter duties, and compensation for loss of future earning capacity
  • Property damage. Repair or replacement of your vehicle or any other property damaged in the accident, such as eyeglasses or personal items
  • Out-of-pocket expenses. Reimbursement for incidental expenses from the accident, such as housekeeping, childcare, and transportation to the doctor
  • Pain and suffering. Physical pain, emotional distress, impairment, loss of quality of life, and other factors that can be hard to put a price tag on

Every case is different, and the value of your claim will depend on your injuries and how they affect your life. Our team will take the time to understand your situation and ensure your claim reflects the full impact of what you have been through.

Frequently Asked Questions About Rear-End Collisions

Below are answers to some of the most common questions we hear from people involved in rear-end collisions. For free legal answers specific to your situation, call (403) 273-8580 to schedule a free consultation.

How Long Do I Have to File a Claim for a Rear-End Accident in Alberta?

The limitation period for rear-end accident claims in Alberta is two years from the date of the accident for most situations, but there are exceptions. Don’t wait to contact a lawyer, as evidence can become more difficult to locate as time passes. We can help you understand deadlines and next steps.

Do I Need a Lawyer if the Insurance Company Already Made an Offer?

If the insurance company has offered a settlement, we recommend speaking with a knowledgeable rear-end accident lawyer first before accepting the offer. Insurance companies may lowball people who are injured in an accident, especially if they don’t have a lawyer.

When you contact Litco Law, we’ll review the offer and give you our honest opinion on whether it’s reasonable. If not, we can build your claim and advocate for a settlement that’s fair.

What if I Was Partially at Fault in a Rear-End Collision?

If you were partly at fault for the accident, you may still be able to make an injury claim. According to Alberta’s Contributory Negligence Act, your compensation would be reduced proportionally to your share of fault. Contact the legal team at Litco Law to get answers to your questions about fault.

How Much Does It Cost to Hire Litco Law?

It costs nothing upfront to hire Litco Law, and you won’t pay anything while your claim is ongoing. We charge a percentage of the settlement we recover for you, with a clear explanation of our fees from the beginning. If we don’t recover for you, you don’t owe us anything.

How Long Will It Take to Settle a Rear-End Collision Claim in Edmonton?

The time it takes to resolve a claim depends on your medical recovery and the complexity of your case. Some claims can be resolved within a few months, while others may take longer in order to get the full picture of your injuries and how they will impact your life.

We know it’s important to you to find resolution as quickly as possible but it’s in your best interest to make sure the full impact of your injuries is known before settling, and that can take time. We’ll keep you informed with updates at least every 30 days while your claim is ongoing.

What Is No-Fault Insurance in Alberta?

The Alberta government has proposed a no-fault auto insurance system they call “Care-First” insurance which would come into effect on January 1, 2027. Under this system, your own insurance company would cover your medical expenses and losses after a collision, no matter who was at fault.

One of the downsides to Bill 47 and the proposed system is that it could limit your right to sue the at-fault driver. The insurance companies could also get to decide what care and compensation you receive, and for how long. In a rear-end collision, that means you may not be able to pursue compensation for pain and suffering or other losses.
